Eligibility

Defendants must have Seattle City misdemeanant charges (i.e. have been arrested by the Seattle Police Department for the present charge). Additionally, they must have a mental health diagnosis, be willing to engage in behavioral health care and abide by court conditions. Clinically indicated treatment must be available. DV and DUI cases require approval from the prosecutor.

Application process

Generally, referrals are made by defense attorneys via email to clinical court services ([email protected]) with the following information: Client name, Case number(s), Client contact/location (In/out of custody, facility, email/phone, etc.), Future court date, Charge(s), and Additional Information (provider, diagnosis, housing info, etc.).

Participation in the Seattle Municipal Court program is voluntary, as defendants waive their rights to a trial on the merits of the case. A court clinician screens potential participants for eligibility and develops an initial treatment plan linking the defendant to appropriate services. Eligible defendants receive court-ordered treatment instead of standard sentencing and are assigned to a special mental health probation counselor. In addition to assisting participants with accessing benefits and services, this court is grounded in a collaborative, supportive multidisciplinary team model that focuses on empowering clients to succeed.
